Workers Compensation Claim from 10 Years Ago...

by Anonymous
(USA)

About ten years ago. I was working for a construction company. I had fallen off a ladder and broke my ankle. I had a claim at that time through workers compensation. However this injury has continued to make my life harder.

Can I still make a claim or sue the company?

Did you settle?

If you had a claim 10 years ago, it likely ended in either a settlement or a denial of the claim?

This information would help us advise you on the status of the claim now. But, in general if you settled the claim, you cannot revive it now because settlements resolve the case completely.

If the claim was denied, you cannot re-raise it now because the statute of limitations would have passed for your injury many years ago.

If, however, you settled the claim with a provision for "lifetime medical" which does occur, you will need to contact the insurance adjuster to ascertain your next steps.

Since laws change frequently and across jurisdictions you should get a personalized case evaluation from an attorney licensed in your state (if you haven't already). Find an experienced local attorney to give you a FREE personalized case review here.

Best of luck,
