The amount awarded by the judge in a personal injury case is why I ask this question. What is a fair fee for the attorney? I appreciate your answer.

Contingency Fee
by: Law Lady

In most personal injury cases, you would have signed a contingency fee agreement before retaining the attorney. That agreement would have spelled out the fees to be paid.

Typically, 33 and 1/3 percent before discovery commences and 40 percent thereafter, plus fees and expenses is standard. Attorneys, however are free to negotiate a rate that is less than quoted above.

To negotiate a fee after the settlement is out of the ordinary, but can be done following the above advice.

Since laws change frequently and across jurisdictions you should get a personalized case evaluation from an attorney licensed in your state (if you haven't already). Find an experienced local attorney to give you a FREE personalized case review here.

Best of luck,
