Personal Injury Mediation Question...

I have a personal injury case and I'm really hating the opposing lawyers, and the case just started. They are pulling very shady moves (and of course they know it) but I am disabled as a direct result of 2 accidents at my previous landlord/owner's apartment building.

I made about $55,000 a year previously but I was also supporting my 92 year old mother. I now lost my job and I am on disability. I really believe I could do better with a mediator. What do you think? Thanks for the help.

From the facts you present it appears you are not represented by an attorney. If so, it is no wonder you are having such a difficult time. What you consider “shady moves” are probably actions you would want your own attorneys to take if they were fighting to protect you.

Your facts seem to indicate you have already filed a lawsuit against the at-fault driver. That being said, if you are not pleased with the manner in which the case is proceeding you can do one of two things...

First: Approach the opposing attorneys and tell them you are not pleased with the manner in which the case is proceeding and would like them to agree to enter into binding arbitration; or

Second: Petition the Court to ask the Court to order both sides to enter into Binding Arbitration.
