Back Injury at Work...

by Mark
(Belvidere, Illinois)

I hurt my back at work. I now have several bulging discs and the doctor said it will be cured with a cortizone shot. If it is, will I get a settlement from work to pay for it and the pain?

Workers Compensation Claim
by: Law Lady

Before you can automatically get payment for your injuries, you will need to submit a claim to the workers compensation carrier for your employer. An adjuster will then be assigned to your case.

They have a procedure which can include sending you to their own doctor for an evaluation. From there, the adjuster determines your rate of disability.

If you are being told that a simple cortisone shot will fix what ails you, it is likely that you will not miss much work or that this is a pre-existing condition that has been flared by your job responsibilities.

If it persists, workers compensation does allow for modified responsibilities to address exacerbating pre-existing injuries.

Since laws change frequently and across jurisdictions you should get a personalized case evaluation from an attorney licensed in your state (if you haven't already). Find an experienced local attorney to give you a FREE personalized case review here.

Best of luck,
