What's a Fair Settlement For Car Accident Injuries?

by Anonymous
(USA)

I was stopped at a red light and was rear-ended by a young kid on his way to school. There were no cars behind me when I stopped at the light and I never saw it coming. There were no skid marks from him braking and I'm not sure he even saw that the cars were stopped to start slowing down.

The force pushed my car into another in front of me. I had my 5 and 6 year old kids in the back seat of the vehicle who were both terrified and complaining of pain the next couple of days. We went to the ER to be checked on and I was prescribed pain medication.

Because I was having issues with my insurance company I had to wait a couple weeks before going to see a primary care doctor. I had a lot of trouble sleeping from back pain waking me up. Because of the accident I missed school and was in bed for a couple days, making it harder for me to catch up with classes.

I was also receiving state assistance for childcare while in school but was required to be employed within the month. I was unable to look for a job as much as I should have and lost my state assistance. Now I struggle to pay daycare.

The situation has been really stressful on top of other life issues. I'm a single parent and don't know what to do to get this issue resolved and move on.

The insurance company offered me $350.00 for each of my kids and $600.00 for myself due to the pain, suffering, and stress this has caused, including traumatizing my children. I don't think that is a fair settlement.

What is a reasonable settlement for personal injury in this kind of auto accident for myself and two children? Thanks.

ANSWER for "What's a Fair Settlement For Car Accident Injuries?":

There are times when we suggest what we believe might be a generally accepted settlement offer. With all of the issues involved in your case, and the very small amount of money the insurance company has offered, we strongly suggest you seek the services of a qualified Personal Injury Attorney.

Most qualified and reputable Personal Injury Attorneys do not charge for an initial office consultation. It would be in your best interest and that of the children to contact an Attorney at the earliest possible time.

Since laws change frequently and across jurisdictions you should get a personalized case evaluation from an attorney licensed in your state (if you haven't already). Find an experienced local attorney to give you a FREE personalized case review here.

Wow! What an insult. I hope you are OK.
Contact your state insurance commissioner if you think the adjuster is jerking you around. The at-fault insurance adjuster kept offering me ridiculously low values for my hard to replace car. After I complained to the commissioner - no problem.

Now onto my bodily injury which includes missed work and missed classes to the point I had to drop one and go to summer school to stay on my graduation schedule. I may have to complain to the commissioner again if they don't fairly compensate me for all of it, including extra tuition for summer and lost summer time. Let alone loss of time dealing with the fallout from this mess!

I cannot believe they are not more concerned about your children. How frightening for them. I would at the very least (for starters) be expecting an extra zero on that BI figure they tried to screw you over with. I was slammed into by an irresponsible teen too. Didn't see me, my brake lights, or turn signal.
