The following summary of North Dakota personal injury laws and case explanations will help you understand important basics of injury claims in this state.

North Dakota Statute of Limitations:

Personal Injury: 2 years for negligent conduct.

Medical Malpractice: 2 years for all general medical malpractice claims up to a maximum of 6 years; and 2 years for claims due to foreign object.

Products Liability: 10 years from the date of purchase or 11 years from the date of manufacture.

Caps on Personal Injury Awards in North Dakota:

There are no personal injury award caps in the state of North Dakota.

North Dakota Serious Injury Threshold:

There is no injury threshold in the state of North Dakota, however there is a monetary threshold of $4,000.


North Dakota is a No Fault state and follows the modified comparative negligence – 50% theory. Therefore a plaintiff must be 49% at fault or less in order to recover.

Personal Injuries & Theories of Liability in North Carolina:

Auto Accident Claim: If an individual negligently operates their vehicle and as a result, injures either a passenger, a pedestrian or someone driving in another vehicle, they will be liable for the personal injuries and property damage.

Wrongful Death Case: A party will be liable to the estate of the victim if, through their negligence, they cause the death of that victim.

Medical Malpractice: When a doctor, nurse or hospital fails to exercise that degree of care and skill required of a professional medical provider, they can be held responsible for any serious injuries that the patient suffers.

Slip and Fall Accident: A property owner will be liable for any and all injuries that arise provided the injuries occur due to a dangerous condition that they either knew about or should have known about through a reasonable inspection. 

Product Liability Lawsuit: Manufacturers, distributors and designers of products can be held strictly liable for the damages that result from those products if they end up injuring consumers.

Workers Compensation Law: Employers in the state of North Dakota are required to carry workers compensation insurance in the event that an employee is injured in the scope of employment.
