No Personal Injury Protection Insurance...

This car accident happened on August 31, 2010. I was going straight and the other car turned left in front of me and caused me to ram into it.

My truck was totaled and my medical bills as of today, including emergency and ambulance of about $17,000, add up to about $26,000. I am still going to the chiropractor once a week.

I did not have Personal Injury Protection (PIP) at the time of the accident and I am incurring medical bills at the moment, would the insurance issue a settlement check to me only? Thanks.

Unless you have an attorney, the insurance company will send a check to you. If you have an attorney, the check would go to your lawyer made in both your names.

As far as having bills, it is very important to tell the medical providers that you are in the middle of a personal injury case. This will give them the option of placing a lien against your settlement.

This assures them payment basically in exchange for them waiting for it. With medical bills of $26,000 you should start your settlement negotiations at somewhere in the range of 4-5 times that figure.
