Injured While in an Inpatient Drug Treatment Program...
by Phoenix
(Livermore, CA)
I was injured (not severely, but enough to go to the hospital) while I was in an inpatient drug treatment program. The hospital wants $2,500 for my injury and treatment.
Since I was under the care and supervision of the program, are they responsible for my medical bills?

ANSWER for "Injured While in an Inpatient Drug Treatment Program...":
Phoenix (Livermore, CA):
It depends... It would be very important to know how you sustained the injuries and what type of injuries you sustained. Certainly the injuries were serious enough for you to be transported to the hospital where you incurred a medical bill of $2,500 dollars.
There are many factors which will determine whether the drug program is liable for your injuries.
If one of the counselors, let's say struck you without provocation, then certainly the program would seem liable. On the other hand, if you struck a counselor and he defended himself and you were injured, then the question of liability becomes a bit murky.
If through no fault of your own you were injured, there is a good chance the program may be liable. But if you in any way contributed to your injuries, possibly by inappropriate behavior, your chance of recovering from the program will be lessened proportionately.
