Injured while attending nursing school...

My friend, while attending, was injured when the plastic seat attachment she was sitting on came loose. She was in a reclining position and fell to the floor.

She injured her back, had X-rays the same day and it was confirmed by the hospital she indeed had an injury. She has been unable to work since the injury but the school had agreed to pay her medical. Does she have a case for anything more than medical?

Payment for Medical Expenses

Your friend is in a fortunate position in that the school has already offered to pay her medical expenses. As far as any other claims for which your friend may be entitled, that would hinge upon whether there is liability.

A property owner is responsible to make regular inspections of property for any hazardous and/or dangerous conditions. They are also responsible to warn of any hazards or dangers that they find. From the facts as you have described, its hard to assess whether the plastic seat was dangerous, hence giving rise to a negligence cause of action.

If the school failed to warn of some danger, then your friend would have a cause of action against the school for premises liability.
