Injured By a Forklift at Work...

I was injured at work. My leg was broken due to a train (something like a forklift) smashing into it. I work in a freezer for a warehouse.

I now have a permanent rod. I was out of work for almost 7 months, then went back to light duty for another 2 months. I had physical training for 3 months 3 times a week. I am only 23 years old.

Am I entitled to anything? If so how much do you think I could get? Thank you.

From the facts you have provided, it sounds as though you are entitled to something.

Since this injury occurred within the scope of your employment, was a Workers Compensation claim opened? If so, you should be working with an adjuster for your medical treatment and to assess your percentage of disability.

What you are entitled to all depends on what you make per hour or per year, the percentage of disability and whether you will ever be returned to your pre-injury condition.

If this is not being handled through your employer's workers compensation insurance, this may be a huge red flag. Please find out and re-submit your question because this will help provide a more clear answer.

Forklift Injury...

On 8/21/2007 I jammed my neck getting on lift. They had installed computers on the lifts. I hit my head three times. The last time I hit my head very hard and damaged vertebrae c4 c5 c7.

I did everything by the books from start to finish. I reached a compromise and release on 09/15/09 for $34,000 with a stipulation open for medical. Now the offer is $55,000 - the $34,000? I don't understand how this works.
