Hit my Head on a Low Sign in a Parking Garage...

by Karen
(Dallas, Tx USA)

I hit my head on a low parking garage stop sign. I got a 3 inch cut on my scalp and it knocked me back against the wall.

I was helping my daughter up on the sidewalk when I hit the sign. My head is sore and it had some swelling, and my neck is sore & stiff. I have taken pictures of the cut. Is there any legal action that I can take on the hit to my head?

ANSWER for "Hit my Head on a Low Sign in a Parking Garage...":

You do have recourse. File an incident report with the parking garage monitors. If you have medical expenses as result of your injury, you may wish to file a claim with the insurance company. This is considered a premises liability claim and it would appear that the sign was simply hung too low (unless you are eight feet tall).

Be advised that any claim would be based upon medical bills so if you did not seek medical attention, you may still want to advise the parking garage attendants to avoid future injury to others.

Since laws change frequently and across jurisdictions you should get a personalized case evaluation from an attorney licensed in your state (if you haven't already). Find an experienced local attorney to give you a FREE personalized case review here.

Best of luck,
