Hit in the face with a door...

by Mary
(San Bernardino, CA)

I was walking to class and a teacher opened a door into the hallway and struck me in the face. There is this yellow square in front of the door and I walked into it.

Is the teacher responsible for my injuries? Is there anything I can do?

ANSWER for "Hit in the face with a door...":

If you believe the teacher acted maliciously or with a purposeful intent to harm you, and as a result you suffered injuries, you should have immediately reported the incident to the Principal’s Office.

The second issue will be the extent of your injuries. If the injuries required medical attention and you incurred medical bills those bills should be delivered to the Principal’s office as well.

You should understand if you make accusations against the teacher of malice aforethought and those allegations are later proven to be false, the teacher may have grounds to file suit against you. If that happens, and you are a minor, your parents may be liable to pay any money damages the court may award against you.

We suggest before you take any action you should look at all of your options. You will have plenty of time to take whatever action you eventually decide on.

Since laws change frequently and across jurisdictions you should get a personalized case evaluation from an attorney licensed in your state (if you haven't already). Find an experienced local attorney to give you a FREE personalized case review here.

Best of luck,
