Hit from behind by a van while walking...

On April 4, 2010 I was walking on the side of a road and was hit from behind by a van. My medical bills totaled $3734.00. The compensation offered was $7500.00.

My injuries were a laceration to my upper left thigh which took 11 staples, bruising and contusion to left elbow which took 4 months to heal, bruising and contusion to left hand which healed in about a month.

I also was hit in the back of the head by the van's side mirror which presented no immediate injury. My concern is possible future medical bills for any future issues which may come up, and also whether or not this is a fair compensation.

I am a hair stylist and massage therapist. I make my living with my arms and hands. I am 49 years old so I have at least another 20 years to work. Is this fair? Will future expenses be covered?

Doesn't sound fair...

The settlement you have been offered is roughly double your medical bills. Generally cases can settle for anywhere from 2.5 - 3 times the medical bills.

With medical bills of $3,734, I would expect your case to settle for at least $9,300 or more. Additional money may be available if your doctor can substantiate the fact that you will need future medical assistance.

Doctors will do so by stating in a medical report something like: "Patient will require an additional 6 months or $1,200 in future medical bills."

If your doctor makes such a statement, you would then request this on TOP of the settlement.

Once you settle a case, you should be advised that there is no going back for more. You will be 100% responsible for your medical expenses once you settle.
