Effective Negotiating Skills: Using Outside Factors to Help Your Case...

Effective negotiating skills can be the deciding factor in getting you a good injury settlement offer.

It’s one thing for your bodily injury claim to be worth a certain amount of money, and quite another to actually be awarded that amount.

Unfortunately you have to work hard to get what you want, and you have to work just as hard to get what you deserve. No adjuster is simply going to hand over any amount of money you ask for.

You'll need to convince the insurance claim adjuster that it's in everyone’s best interest to give you a fair settlement. You can do this using effective negotiating skills.

Using 'outside factors' can strengthen your claim negotiations. Instead of just telling the truth and demonstrating the truth, you have to backup the truth, strengthen the truth and bring in other truths.

These “other truths,” or outside factors, are things that shouldn’t really affect your settlement amount, but they do.

These can be anything from witness testimony showing that other people believe in your truth, to finding ways to defend the accuracy of witness testimony, to simply underlining the dramatic nature of the accident.

None of this changes the fact that you were injured or how much the other person was negligent. But it's necessary in negotiating a larger insurance settlement.

Convince the claim adjuster they'll lose if your case goes to court.

An adjuster also must be shown that the outside factors involved will make the court rule for even higher damages. It's therefore a good negotiation skill to point all of these things out as you go along.

Aside from demonstrating accuracy in your witness statements, you can look into things like the status of the defendant's driving record. You aren’t entitled to access these records while making a claim, but the adjuster knows these records will be revealed if the case goes to court.

If you know or think that the defendant has a bad driving record, then bring it up when negotiating your insurance settlement. If the injury claim is for another kind of accident, you can look into other kinds of safety records.

Effective negotiating skills are important throughout the entire personal injury accident claim process. You must not only look for all the outside factors, but you need to bring them up at the proper times. The next section will deal more closely with negotiation strategy.
