Cut at a Nail Salon

Well, in august of 2009 i was getting a pedicure at a local nail salon. One of the people that work there cut the side of my left foot with a razor and caused it to bleed alot. They put a product on it called Stop Bleed. It introduced a bacteria into my foot and it spread.

I was unable to walk for several weeks without a crutch or some other support. I cannot wear shoes still and i have severe pain. I have over ten thousand dollars in doctor bills due to this injury. I will need surgery but without insurance i can not do so.

I recently found out that the party that injured me does not have insurance and will be paying out of pocket for my expenses. they have agreed to pay all my medical bills. I am unsure how much to ask for pain and suffering. What do you think?

Answer:

Injury values differ depending on the venue and I am not familiar with values in Missouri. However, the value range in NY is $5,000-$10,000 without the surgery. I would imagine it is less in Missouri.

Once you have the surgery the value goes up significantly (but they will not pay on a "possible" surgery. Only once you have had it.)

Also, since they are paying out of pocket, you may have to settle for significantly less. Some money is better than none and if you don't accept their best offer (never accept their first offer) you need to bring a lawsuit and obtain a judgment.

This is a lengthy process and you may not be able to collect on it depending on their financial situation (which I would assume is not great if they can't even afford insurance).
