Class Action Lawsuit Case Info to Increase
Personal Injury Settlement Averages...
A class action lawsuit case works the same way as a
regular
lawsuit, but
it affects the plaintiff very differently.
Basically, a class
action suit is when a lot of people get together as a group to
go
after similar damages at the same time.
These kinds of cases raise the
stakes considerably. The personal injury settlement averages increase
substantially and the defendants wind up with a lot on the line.
Class action lawsuit cases come about when a group of people are
seeking
damages against the same party for the same basic reason.
In cases of
personal injury this would most likely be the result of a defective
product.
Imagine if hundreds or even thousands of people are
injured because a product was defective. If every one of them needed to
sue for damages the courts would be hopelessly clogged trying the same
case over and over again.
In the past, this situation has actually
resulted in companies getting off the hook, because the courts simply
couldn’t handle the case overload.
The solution to this was a
legal amendment that allows groups of people to take part in one
lawsuit. In these cases one
or two people are chosen as the primary
plaintiffs. These people are chosen because their case is
deemed to be
representative of the whole.
They'll be the ones approving all of the
lawyers' actions and, in most cases, appearing on the stand to answer
questions.
Whatever the jury decides in these cases is binding,
both for the defendant and every single person involved in the action.
This means that if you're involved in a class
action lawsuit case and things don’t go your way, you're not
allowed to sue separately later on.
It's often in
your best interest to take
part in the class action suit. By joining many
other plaintiffs
you're able to afford much better legal services. A
hundred claims together are worth a hundred times more than each case
by itself.
That means the legal team will collect a hundred times more
in legal fees. However, you should know that not all class action
lawsuit cases result in
equal personal injury settlement averages going to each plaintiff
within the action.
For that same reason it's often impractical to pursue legal actions on
your own. If the damages were less than a thousand dollars, it isn’t
worth your money or the lawyers' time to represent you. By joining a
class action lawsuit case things suddenly turn in your favor. Also,
unless
you’re the primary plaintiff, you'll
invest a lot less of your own time.
On the other hand, there are reasons to opt out of a class action
lawsuit. Once a class action gets going the lawyers will be seeking out
as many plaintiffs as they can find.
When they contact you, or if you
contact them, you'll want to know all the details of their case. You
may find that your situation differs enough from the class action to
warrant a separate trial.
And there will be other times where
you feel that the lead plaintiffs, and even the lawyers involved,
aren’t looking after your own best interests.
Another reason to
opt out of this kind of suit is if your stakes in the claim are so
high that you want to be on the front lines of the legal battle. If
you're not the primary plaintiff in a class action lawsuit case then
you won't
have much, if any, involvement in the case.
