Burned by Hot Wax at the Beauty Salon...

I went to a salon and had my eyebrows and upper lip waxed. The wax was too hot and burned me and left a mark on my eyes and lip. The lady who was doing it was preoccupied talking to other people while she was doing it.

I was just wondering how much this would be worth for the pain and suffering and if it would be worth it to file a claim?

Pain and suffering is measured by your medical bills, typically. Therefore, unless you had injuries warranting medical care, the claim would not be worth a lot.

If you did receive medical care, any potential settlement would be based (at least in part) on these bills. Pain and suffering also includes such things as scarring or disfigurement. If, as a result of the wax, you now have a scar on your face, this is also worth a lot given that it is on your face.

It is clear that the lady performing your waxing was negligent in that she failed to recognize that the wax was too hot due to her own pre-occupation. But, negligence alone without damages rarely yields much in the way of settlement.

The value of your case and pain and suffering is contingent upon your medical bills. Without bills you can also base a claim on permanent scarring or disfigurement.

Assuming that you have a scar, you may be able to base a claim on its value -- Here are some thoughts in that regard:

Scars that are in obvious places, or that impact one's attractiveness such as you have described are worth more. If you are in a field where your looks are integral (i.e. a model) this claim would be worth even more.

If however, you are not left with a scar and do not have medical bills this would be a case of nominal value (under $1000).
