Arbitration Forums: What to Expect...
Arbitration forums usually take a few months to get through, after
filing the initial requests. The actual meeting will resemble a small
claims
hearing to a certain degree.
You’ll
make a similar opening argument in which you explain the accident, your
injury
damages and why you feel you deserve the injury settlement
amount you demanded.
Bring all
your
documentation. Unlike small claims court,
arbitration forums give plenty of time for the arbitrator to view all
the paperwork.
The speech you make doesn't have to sound as
formal as the one you'd make in court, but this doesn’t mean you should
spend any less time preparing for it.
On the contrary, you'll want to
spend more
time since arbitration forums give you the option to speak for as long
as you like.
However, you shouldn't need longer than 15-20 minutes to make a concise
but detailed statement. In it you'll present your case as you did in
your
initial claim letter,
point-by-point and in plain English. You'll have time to dwell on any
particulars and present supporting evidence in detail.
You want to
emphasize the
extent of your pain and suffering as best you can, so
take advantage of the informal setting that legal arbitration provides.
Like a civil court case, you don't want to interrupt the other side's
arguments during the hearing. But
you should take notes because you’ll be given an opportunity to refute
their arguments later. If you choose, you can also ask the other side
some direct questions as you would a witness in a court case.
The dispute won’t come to a resolution immediately after the
arbitration proceedings end. Instead the arbitrator will take time
to weigh each side's evidence and arguments.
They may ask to see other documents you don’t have
with you at the hearing. You’ll need to get these to them soon after
the hearing.
Except in that lone situation, you're not allowed to contact the
arbitrator afterwards, since you can't add anything more to your
argument.
When the legal arbitration hearing is over you'll
have to wait. Sometime in the next month you'll hear a decision. No
matter what you or the insurer thinks, that decision is final.
